Clarification of the Current Availability of H1B visas for the 2010 and 2011 Caps
The H1B Cap is the official term for the annual quota (number) of H1B visas that are made available each year by the US Immigration Bureau (USCIS)
- Last year the 2010 H1B Cap / Quota made a total of 85,000 'new' H1B's available
- This year the 2011 H1B Cap / quota also makes available a total of 85,000 'new' H1B visas
H1B cap / Quota Current Availability Remaining from 2010
- 4,300 H1B visas are still available and can be filed towards last years 2010 Cap numbers
- these H1B visas can be filed immediately with employment authorization start dates
H1B Cap / Quota Current Availability for 2011 - 85,000 new H1B visas are available that can be filed and issued this year, which will be counted towards the 2011 Cap numbers
- this years 2011 H1B visas can be filed from April 1st onwards and filing can continue until such time as all the visas have been issued
The annual H1B Cap / Quota is only for 'new' (first time) H1B visa applications - H1B Transfers are NOT counted towards the annual Cap / quota numbers
- H1B Extensions and Renewals are NOT counted towards the annual Cap / quota numbers
- 'New' H1B visas can also be filed and counted towards the Cap-Exempt H1B Visa Program
- For the above: visas applications can be filed at any time of year and there are no restrictions or quota limitations on the number of visas that can be filed
For those that want or need an H1B visa quickly: because there are still H1B visas remaining from the 2010 Cap / quota - they have already passed the H1B programs regulatory filing and employment periods - which means they can now be filed immediately with employment start dates
H1B employers are still recruiting for the available 2010 H1B visas, and the USCIS welcomes and continues to accept new H1B applications until all the remaining visas have been issued
For those that want an H1B visa from this years 2011 quota: because there is a quota system (limited availability each year) , many of the regular and largest H1B employers start recruiting and selecting from January which helps them eliminates traditional sponsorship risks, allows sufficient time to find and sponsor the best candidates, and be prepared and ready to file applications early which safeguards and helps ensure they get issued visas first
